Terms of Use

1. Scope and acceptance

These Terms govern use of the KINOCUS application and the https://kinocus.com website, provided by Sergio Callarelli. By installing or using the application, the user accepts these Terms and the applicable rules of the store from which it was obtained.

For distribution through European Union app stores, the provider acts as an individual trader. The current version contains no advertising, in-app purchases, or subscriptions. Before introducing paid products, advertising, or another monetization model, we will update these Terms, the Privacy Policy, and the declarations required by the stores.

Installations obtained through the App Store are also subject to Apple's Standard End User License Agreement unless a valid custom agreement is posted on the store. If terms conflict, mandatory platform terms and applicable law prevail.

2. License

We grant the user a personal, limited, revocable, non-exclusive, non-transferable license to install and use KINOCUS on devices they own or control, subject to the platform rules.

The user may not distribute, sell, sublicense, circumvent protections, interfere with operation, or attempt to derive source code, except where expressly permitted by law or by the licenses of open-source components.

3. Nature of the service

KINOCUS is a coordination and skill game. Scores, levels, feedback, and Challenges are provided solely for entertainment.

KINOCUS is not a medical device, treatment, diagnostic tool, rehabilitation program, or healthcare service. It does not replace professional advice and does not guarantee physical, neurological, or cognitive improvement.

Stop using the application if you experience pain, discomfort, fatigue, or sensitivity to motion, light, sound, or vibration. Use the available settings to reduce or disable audio and haptic effects.

4. Progress and local availability

The current version stores progress and preferences on the device. Deleting the application, clearing its data, device failure, or backup settings may cause progress to be lost or restored. Without a KINOCUS cloud service, we cannot recover a user's local data.

We may correct errors, update compatibility and content, or discontinue a version when necessary. We do not promise that every feature or build will remain available indefinitely, subject to applicable law.

5. Result sharing

The user decides whether and where to share text or images generated by the result screen. The user is responsible for selected recipients and compliance with the chosen sharing service. The feature must not be used to distribute unlawful or harmful content or material that infringes third-party rights.

6. Intellectual property

KINOCUS, its logo, interface, original content, artwork, audio, and game elements are protected by applicable law and belong to Sergio Callarelli or their respective licensors.

Open-source components and fonts remain subject to their respective licenses. These Terms do not limit rights granted by those licenses. Third-party audio remains subject to its author's license. Licenses, attributions, and source references are available on the Open-source licenses and third-party materials page.

7. Third-party services

The store, operating system, backups, share sheet, and applications chosen by the user are third-party services. Their operation and data practices are governed by their own terms and policies.

8. Warranties and liability

KINOCUS is provided with the level of care required by law. To the extent permitted, we do not guarantee that the service will always be error-free or compatible with every device, accessory, or future operating-system version.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, or affects the user's mandatory consumer rights.

9. Minors

KINOCUS is not specifically designed for children. Minors must use the application with any consent and supervision required by applicable law and the platform's family settings.

10. Suspension and termination

The user may stop using KINOCUS at any time by uninstalling it. We may revoke the license for a material breach of these Terms, subject to the user's mandatory rights.

11. Changes

We may update these Terms to reflect legal changes or new features. The updated version will be posted at the same address with a new effective date. Where required, we will provide additional notice.

12. Governing law and contact

These Terms are governed by Italian law, without depriving a consumer of mandatory protections under the law of their country of residence.
